This Privacy Policy covers the website: www.joinpakt.com and any parent or child sites. This Privacy Policy explains our policies and procedures regarding information we collect from or about our customers and their use of our products and services. PAKT intends to provide you with a level of comfort and confidence in how we collect, use, share, and safeguard information that we collect. This Privacy Policy also explains how you can contact us if you have any questions or concerns. By providing information to us or by using our products and services, you agree to the terms and conditions of this Privacy Policy.
As an insurance provider, PAKT is regulated by Federal and State laws that protect your information and our use and disclosure of it. This Privacy Policy is incorporated into and is subject to the PAKT Terms of Service (the “Terms”), and capitalized terms used, but not defined in this policy, have the meanings given to them in the Terms.
At PAKT, we use information from or about you for any of the following purposes:
• to respond to your inquiries and fulfill your requests;
• to process your application for a quote;
• to process and service your insurance policy;
• to settle your claims;
• to send you information about our products and services and offer you additional products and services that we think may be of interest to you;
• for our business purposes, such as data analysis, audits, fraud monitoring and prevention, identifying usage trends, determining the effectiveness of our promotional campaigns, and operating and expanding our business activities;
• to otherwise provide and improve our products and services;
• as otherwise permitted or directed by you.
If you apply for a quote for yourself and any other person(s), we also may use such person's/persons' information in the same manner.
Except as described above and below, PAKT Insurance Agency, LLC may use or share information that does not personally identify you for any purpose, such as for operational or research purposes, for industry analysis, to improve or modify our products and services, to better tailor our products and services to your needs, and where legally required.
We may collect a variety of information from or about you, your co-applicants, or your devices for the purposes described above. This includes information you provide us in your application, your transactions with us, consumer reports, on the Internet, by phone, via a mobile application, by email, through our service providers, your use of the Service, or by any other legal means. PAKT collects a variety of information that will aid us in quoting and servicing your insurance policy and providing the Service to you. This information includes “nonpublic personal information”, which is all information that identifies you and is not available to the public. Examples of such information include your name, address, residence information, telephone number, email address, vehicle identification number, driver's license number, driving history, claims history, current or former insurance information, social security number, medical information, gender, educational background, date of birth, marital status, and PAKT web pages you visited.
The types of personal data we gather, and share, depend on the product and services you request to use and your relationship to us, not all of these types of information may be applicable to you. For example, we may gather different data if you are a claimant reporting an accident than if you want a quote for auto insurance. The data we gather can include your Social Security Number, income, transaction data such as account balances and payment history, and data from consumer reports. It may also include data gathered in connection with our provision of insurance services, when you apply for such services, or resulting from other contacts with you. It may also include:
Identifiers, including a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, Social Security Number, driver’s license number, or other similar identifiers.
Personal Data. "Personal Data" is defined as any information that you may provide to us that can be used to identify you individually, including, but not limited to, contact information, business address, home address, fax numbers, driver's license number, state identification card number, bank account number, credit card or debit card number, passport number, alien registration number, as well as any company account number that we assign to you.
Personal Data That You Provide Through the Services: We collect Personal Data from you when you voluntarily provide such information, such as when you contact us with inquiries, respond to one of our surveys, register for access to the Services or use certain Services.
Non-Identifiable Data. You can use certain Services to obtain certain information without revealing any personally identifiable information. During these types of visits, we may collect, analyze, or share such information on an anonymized basis. We use this information to generate statistics and measure the activity of our Services in order to improve the usefulness of the Services and the customer experience.
By voluntarily providing us with Personal Data, you are consenting to our use of it in accordance with this Privacy Policy. If you provide Personal Data to the Services, you acknowledge and agree that such Personal Data may be transferred from your current location to the offices and servers of PAKT and the authorized third parties referred to herein located in the United States.
Other Information:
Non-Identifiable Data: When you interact with PAKT through the Services, we receive and store certain personally non-identifiable information. We may passively collect information such as browser type, ISP, referring/exit pages, operating system, access date/time stamp, and clickstream data. We use this information to improve the usability of our Services. Such information is collected passively using various technologies and cannot presently be used to specifically identify you. PAKT may store such information itself or such information may be included in databases owned and maintained by PAKT affiliates, agents, or service providers. The Services may use such information and pool it with other information to track, for example, the total number of visitors to our Site, the number of visitors to each page of our Site, and the domain names of our visitors' Internet service providers. It is important to note that no Personal Data is available or used in this process.
In operating the Services, we may use a technology called “cookies, clear gifs, and other technologies.” A cookie is a piece of information that the computer or mobile device, that hosts our Services gives to your browser when you access the Services. Our cookies help provide additional functionality to the Services and help us analyze Services usage more accurately. For instance, our Site may set a cookie on your browser that allows you to access the Services without needing to remember and then enter a password more than once during a visit to the Site. In all cases in which we use cookies, we will not collect Personal Data except with your permission. Most web browsers automatically accept cookies and session IDs, but you may be able to disable cookies by making the appropriate selection from your browser options. Aggregated Personal Data: In an ongoing effort to better understand and serve the users of the Services, PAKT often conducts research on its customer demographics, interests and behavior based on the Personal Data and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and PAKT may share this aggregate data with its affiliates, agents, and business partners. This aggregate information does not identify you personally. PAKT may also disclose aggregated user statistics to describe our services to current and prospective business partners, and to other third parties for other lawful purposes.
Protected classification characteristics described in California Civil Code § 1798.80(e), including age, race, color, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, or veteran or military status.
Commercial data, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories and tendencies.
Internet or other similar network activity, including browsing history, search history, data about a consumer’s interaction with a website, application, or advertisement.
Professional or employment related data, including current or past job history.
Inferences drawn from other personal data, such as a profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
Risk data, including data about your driving and/or accident history; this may include data from consumer reporting agencies, such as your motor vehicle records, and loss history data, health data, or criminal convictions.
Claims data, including data about your previous and current claims, which may include data regarding your health, criminal convictions, third party reports, or other personal data.
Location Information: Our Service may collect and use your location information (for example, by using the GPS on your mobile device) to provide certain functionality of our Service. If you choose to enable our location features, your location information may be publicly displayed within the Service. Please keep in mind that other users can see this information about you, and they may use it or disclose it to other individuals or entities outside of our control and without your knowledge. Your location information may be subject to abuse, misuse, and monitoring by others, so please be careful if you choose to enable location functionality. We may also use your location information in an aggregate way, as described above in the “Aggregated Personal Data” section.
Analytics; Do Not Track Signals: We may (and we may allow third party service providers to) use cookies or other technologies to collect information about your browsing activities over time and across different websites following your use of the Services. For example, we use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help the website analyze how users use the Site and enhance your experience when you use the Service. Our Service currently does not respond to “Do Not Track” (DNT) signals and operates as described in this Privacy Policy whether or not a DNT signal is received. If we do so in the future, we will describe how we do so in this Privacy Policy.
If you are a PAKT Customer, we will also collect information about your transactions with us and others, including our affiliates. This includes information such as your policy coverage levels, account balances, claims history, and billing information.
As permitted by state law, we may collect information about you from affiliated and nonaffiliated third parties, including insurance support organizations and consumer reporting agencies. PAKT contracts with third party services and application providers that are linked or connected to your account to provide you enhanced features and functionalities in relation to our products and services, and to provide and improve our products and services (“Linked Applications”). This may include information such as vehicle reports, consumer credit information, demographic information, insurance histories, driving histories, and insurance claims reports. Information obtained from insurance support organizations may be retained by such organizations and disclosed to other persons as permitted by law. By submitting an application for insurance coverage, you authorize PAKT to request your credit report.
We may disclose information about our current, former, or potential customers as permitted or required by law, or as permitted or directed by you.
For example, we may disclose information from or about you to affiliated and nonaffiliated insurance companies, insurance agents, reinsurance companies, and insurance support organizations, such as consumer reporting agencies, government entities, and claims administrators. We may also disclose such information to nonaffiliated third parties that perform services or functions on our behalf including the marketing of our products or services. Further, we may also disclose such information as necessary to effect, administer, or enforce a transaction that you request or authorize, or in connection with servicing or processing a transaction that you request or authorize.
The following are examples of situations in which we may disclose information from or about you:
• Information from or about you may be passed between us and our agents, appraisers, attorneys, investigators, and others who may be involved in the sales and marketing of PAKT products and services, processing of applications, and servicing of policies or claims.
• If you request a comparison quote, information from or about you may be shared with an affiliated insurance agent and third-party insurance companies in order to provide you with the requested comparison quotes.
• We provide your policy information to adjusters and other appropriate business entities that make any necessary repairs to your vehicle or property insured by us when you have a claim.
• We may provide information from or about you to others whom we determine need such information to perform insurance or other professional functions for us. These may include parties helping us with administrative services and consumer reporting agencies.
• We may supply information as required by search warrant, subpoena, or legal process, to state insurance departments, or other law enforcement or government authorities when required by law, or to protect our own legal interests in the event of suspected illegal or fraudulent activities.
• If we collect information from or about you as an agent for one of our business partners, we may use it to contact you or make you an offer regarding insurance products that may be of interest to you.
• We may share information from or about you with a third party in connection with any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).
We do not share information that personally identifies you with unaffiliated third parties for their marketing purposes unless you opt into that sharing.
PAKT may contact you regarding your policy and our products and services, such as insurance rate quotes, billing notices, confirmations of changes, changes to our products, and other PAKT-specific communications. We will also use your email to provide you with updates about our products and services. We may also contact you by phone regarding timely matters such as late payment or other factors that might affect your policy. You may NOT unsubscribe from these PAKT-specific communications that relate to your primary usage of our service and products, and you agree to receive these communications if you make a purchase.
When you request and receive a quote or become a policyholder with us, PAKT may contact you about third-party promotions, our products and services, and other information that may be useful to you. In addition, prior to purchasing a policy or after canceling your policy, PAKT may contact you to confirm your quote or invite you to come back and get a new quote or to purchase a policy. You will have the ability to unsubscribe from whichever type of communication you received.
We seek to use reasonable organizational, technical, and administrative measures to protect information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. We have certain physical, electronic, and procedural safeguards in place that are designed to help protect the security and integrity of your information both during transmission and once it is received. To reduce the risk that your account may be compromised, we recommend the use of passwords greater than eight characters, and that include letters, numbers, and special characters, and that you regularly change your password to one that you have not used within the last year. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account with us has been compromised), please immediately notify us of the problem by contacting us in accordance with the "How to Contact Us" section below.
The PAKT Insurance Agency, LLC website may contain links to our business partners and links to other sites offering valuable information. If you choose to provide any information to any of these entities, the collection and disclosure of your information by that entity will be governed solely by that entity's privacy policy. PAKT makes no representations or warranties regarding these sites.
As a policyholder, you can always review and update your information by calling our customer service center at 415-275-1774. All consumers have the right to know the information that PAKT has about them, to make changes to that information, and to know the identity of any entity that PAKT has disclosed that information to within the previous two years. To make such an inquiry please call our customer service center or write to the address listed below and identify the information you would like. You will be required to provide certain information for identity verification purposes. If your information is immediately accessible when you call, the customer service representative will review it with you, and you may make changes to it at that time. If your information is not immediately accessible when you contact us, within 30 (thirty) business days, PAKT will inform you of the types of information we have about you. If you would like to further review the information, you may review and copy the information in person at our customer service center or request a copy be sent to you by mail. PAKT may charge a fee for providing a copy by mail.
Our products and services are not directed to individuals under the age of eighteen (18), and we request that these individuals not provide any information to PAKT.
In the event that all or a portion of PAKT or its assets are acquired by or merged with a third-party entity, we reserve the right, in any of these circumstances, to transfer or assign the information that we have collected from users, including personal information and user data in connection with such merger, acquisition, sale, or other change of control. You will be notified via email and/or a prominent notice on our website of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.
As permitted by law, We may change this Privacy Policy from time to time. Please take a look at the "Policy last updated" legend at the top of this page to see when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on our website. By using our products or services, or otherwise providing information to us following these changes, you accept the revised Privacy Policy.
